Decent Work Agenda: Main Changes

On the 1st of May, in the scope of the Decent Work Agenda and the Valuing of Young People in the Labour Market, it was published the Law 13/2023, contemplating several measures aiming at fighting precariousness, promoting a better conciliation between professional, personal and family life, and stimulating the workers' participation in collective bargaining.

One of the most relevant alterations made by the Decent Work Agenda was in the matter of fixed-term contracts, more specifically regarding the succession of fixed-term contracts, as well as compensation for the expiry of the contract, whether for a fixed or uncertain term.

The duration of temporary contracts now has maximum limits, when the same function is being performed, even if the employer is different. The legislator has also reduced to four the number of renewals of temporary contracts.

Within the ambit of professional traineeships, there were changes regarding the traineeship subsidy, which is now remunerated at a minimum of 80% of the National Minimum Salary and which, for the purposes of Social Security contributions, is now equated to salaried work. The traineeship promoter is also obliged to take out an occupational accident insurance policy.

With regard to parental protection and conciliation of professional and family life, the legislation underwent some changes. Regarding Parental Leave, there is now an increase in the allowance when it’s shared equally between the parents, and from 120 days, the Leave may be used part-time by both parents, increasing the total duration. The Father's exclusive Leave also underwent alterations and can now be taken for 28 consecutive or interspersed days.
